ExperienceMiamiBeach.com (the “Site”) is operated by the Miami Beach Visitor and Convention Authority (“MBVCA,” “we,” “us,” or “our”). MBVCA is a seven-member authority appointed by the City of Miami Beach Commission to encourage, develop, and promote Miami Beach as a visitor destination.
These Terms of Use govern your access to and use of the Site. This Privacy Policy explains how we collect, use, and disclose information through the Site. By accessing or using the Site, you acknowledge that you have read and understood these Terms of Use and Privacy Policy. If you do not agree, please do not use the Site.
PART I — TERMS OF USE
1. PURPOSE OF THE SITE
The Site is an informational and promotional resource for discovering Miami Beach events, restaurants, hotels, attractions, tours, deals, news, and curated travel Guides. It is intended to help visitors explore and plan experiences in the City of Miami Beach, Florida.
The Site is not a booking platform, ticket seller, travel agency, hotel operator, restaurant operator, event producer, or payment processor. MBVCA does not conduct event registrations, sell tickets, make hotel or restaurant reservations, or sell or redeem deals through the Site. Transactions are completed on third-party websites and are governed by those third parties’ terms, policies, availability, refund rules, and customer-service practices.
The Site is not an emergency, weather, traffic, health, safety, or professional-advice service. For urgent or authoritative information, consult the appropriate government agency, emergency service, venue, transportation provider, or other primary source.
2. INFORMATIONAL CONTENT AND ACCURACY
We strive to provide useful and accurate information, but listings and other content may be supplied by government sources, event platforms, venues, businesses, organizers, content partners, or other third parties. Restaurant and hotel listing data is provided directly by the City of Miami Beach. Event information is sourced primarily from Ticketmaster and may also include major events supported through MBVCA’s grant program and events from MBVCA’s annual calendar.
Event dates and times, hours of operation, prices, menus, amenities, accessibility, routes, availability, participation requirements, deal terms, expiration dates, and other details may change without notice. An event or offer page may remain available after the event or offer has ended. You should verify material details directly with the applicable venue, organizer, merchant, ticketing provider, or other third party before traveling, making plans, or entering into a transaction.
To the fullest extent permitted by law, MBVCA does not warrant the completeness, accuracy, timeliness, reliability, or continued availability of Site content.
3. THIRD-PARTY WEBSITES, SERVICES, AND TRANSACTIONS
The Site contains links to third-party websites and services, including ticket sellers, event organizers, hotels, restaurants, attractions, deal providers, social media platforms, app stores, and tour technology providers. These links are provided for convenience and informational purposes.
MBVCA does not control and is not responsible for a third party’s website, content, security, accessibility, privacy practices, products, services, representations, availability, pricing, payment processing, fulfillment, cancellations, refunds, or other conduct. A link or listing does not create an agency, partnership, joint venture, or contractual relationship between MBVCA and the third party, and does not constitute a guarantee of the third party or its offerings.
When you leave the Site, your activity and any resulting transaction are governed by the third party’s own terms and privacy policy. Any questions, claims, or disputes concerning a third-party transaction must be addressed to the applicable third party.
4. CURATED GUIDES, EXPERT CONTENT, AND SELF-GUIDED TOURS
The Site’s Guides and Tours may be developed with local experts, historians, cultural organizations, and travel influencers in collaboration with MBVCA for the purpose of promoting Miami Beach as a travel destination. Recommendations reflect editorial judgment and may include the personal views and experiences of the identified contributor. A contributor’s personal statements, accounts, social media activity, or other content outside the material published or commissioned by MBVCA are the contributor’s own and are not statements by MBVCA.
Recommendations, inclusion in a Guide or Tour, and “local-approved” or similar editorial descriptions do not guarantee quality, safety, suitability, availability, accessibility, or a particular experience. Visitors should make their own decisions based on their interests, needs, and circumstances.
Tours described on the Site are generally self-guided and may be accessed through a browser or the EXP Miami Beach Tours mobile app. They are not staffed or supervised unless a Tour page expressly states otherwise. Conditions along a route may change due to weather, construction, traffic, special events, closures, tides, maintenance, or other circumstances. You are responsible for remaining aware of your surroundings, following posted rules and applicable laws, respecting private property, evaluating your own health and mobility needs, and deciding whether a location or route is safe and appropriate for you.
The EXP Miami Beach Tours mobile app, app-store downloads, and any separately hosted tour platform may have additional terms and privacy notices. Unless expressly stated otherwise, this Privacy Policy applies to ExperienceMiamiBeach.com and does not replace notices presented by an app, app store, or separately hosted service.
5. EVENT SUBMISSIONS
The Site allows members of the public to submit events for possible publication. Submission does not guarantee approval or publication. MBVCA may review, edit, decline, delay, remove, or correct a submission at its discretion.
By submitting an event, you represent that:
• the information is accurate to the best of your knowledge;
• you are authorized to submit the event and any associated text, image, link, logo, or other material;
• the submission does not infringe or violate intellectual-property, privacy, publicity, contractual, or other rights; and
• any necessary permissions or releases have been obtained, including for identifiable individuals shown in submitted images.
You grant MBVCA a nonexclusive, royalty-free, transferable, sublicensable, worldwide license to host, reproduce, edit, format, adapt, publish, display, distribute, and promote the submitted event content in connection with MBVCA’s tourism, informational, archival, and promotional activities. This license continues for as long as reasonably necessary for those purposes and for applicable public-records and archival obligations.
Do not include confidential information, sensitive personal information, payment-card information, government identification numbers, medical information, or other unnecessary personal information in an event description, image, or other field intended for publication.
Contact names and email addresses supplied through the event form are used for submission review, confirmation of acceptance, and follow-up questions. They are not intended to be displayed with the event listing. However, submissions and related correspondence may constitute public records and may be retained or disclosed as required by Florida law, subject to applicable exemptions.
6. INTELLECTUAL PROPERTY
The Site and its text, Guides, Tour content, photographs, graphics, logos, designs, audio, video, software, and other materials are owned by MBVCA or used with permission from their respective owners and are protected by applicable intellectual-property laws.
You may access and use Site content for personal, informational, and noncommercial purposes. Except as permitted by law or with prior written authorization from the applicable rights holder, you may not reproduce, modify, republish, sell, license, distribute, publicly display, create derivative works from, or commercially exploit Site content. Nothing in these Terms grants ownership of any MBVCA, City of Miami Beach, contributor, venue, business, or third-party trademark or other intellectual property.
7. ACCEPTABLE USE
You agree not to:
• use the Site for an unlawful, fraudulent, harmful, or abusive purpose;
• interfere with the Site’s operation, security, or availability;
• attempt to gain unauthorized access to systems, accounts, or data;
• introduce malware or other harmful code;
• impersonate another person or misrepresent your affiliation or authority;
• submit false, misleading, defamatory, infringing, obscene, or unlawful material;
• collect personal information about others without lawful authorization; or
• use the Site in a manner that violates another person’s rights.
MBVCA may restrict access, reject submissions, or take other appropriate action in response to suspected misuse.
8. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. MBVCA DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. MBVCA DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
9. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, MBVCA AND ITS BOARD MEMBERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, CONTENT CONTRIBUTORS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF DATA, REVENUE, PROFITS, OR OPPORTUNITY; PERSONAL INJURY OR PROPERTY DAMAGE; OR CLAIM ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE, RELIANCE ON SITE CONTENT, PARTICIPATION IN A TOUR OR ACTIVITY, OR INTERACTION OR TRANSACTION WITH A THIRD PARTY.
Nothing in these Terms shall be construed as a waiver of sovereign immunity or of any limitation, defense, or protection available to MBVCA or any governmental entity under the Florida Constitution, Florida law, or other applicable law.
10. INDEMNIFICATION
To the extent permitted by law, you agree to defend, indemnify, and hold harmless MBVCA and its board members, officers, employees, agents, and contractors from claims, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, unlawful use of the Site, or event submission, including a claim that submitted material infringes another person’s rights.
11. GOVERNING LAW AND VENUE
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any action arising from these Terms or the Site shall be brought in a court of competent jurisdiction in Miami-Dade County, Florida, unless applicable law requires otherwise.
12. CHANGES, SUSPENSION, AND SEVERABILITY
MBVCA may modify the Site or these Terms at any time. Updated Terms will be posted with a revised “Last Updated” date. Your continued use of the Site after an update constitutes acceptance of the revised Terms to the extent permitted by law.
MBVCA may suspend or discontinue any part of the Site without notice. If a provision of these Terms is held unenforceable, the remaining provisions will remain in effect. These Terms constitute the agreement between you and MBVCA concerning use of the Site, except where another written agreement applies.
PART II — PRIVACY POLICY
1. SCOPE
This Privacy Policy applies to information collected through ExperienceMiamiBeach.com. It does not govern a third-party website, service, transaction, social media platform, app store, or separately hosted mobile application or tour platform, even if linked from the Site. Review the privacy notice provided by the applicable third party before providing information.
2. INFORMATION WE COLLECT
A. Newsletter subscriptions
When you select “Become an Insider,” you are directed to a subscription form hosted by Constant Contact. We collect the email address and any other information you choose to provide through that form for the Experience Miami Beach Monthly News newsletter.
Subscribers may occasionally receive additional communications about specific Miami Beach events or City initiatives. The subscriber list belongs to and is controlled by MBVCA and is used only for these MBVCA communication purposes. We do not provide the list to unrelated parties for their own marketing. Constant Contact processes subscriber information to provide email-distribution and related services to MBVCA.
You may unsubscribe at any time by using the unsubscribe link included in an email. Unsubscribing stops future marketing or promotional emails but may not prevent a communication required by law or necessary to complete a request you made.
B. Event submissions
When you submit an event, we collect the information entered or uploaded through the form. This may include the event name, start and end date and time, venue name, event or ticket URL, venue address, event description, event image, your full name and email address, and whether you are the event host.
Event information and submitted images may be edited and published on the Site or used to promote the event. Your contact name and email address are used for submission review, acceptance confirmation, and follow-up questions and are not intended to be published with the listing.
C. Communications
If you contact MBVCA, we may collect your name, contact information, message, and any other information you provide so that we can respond and maintain appropriate records.
D. Information collected automatically
When you use the Site, MBVCA and its service providers may automatically collect technical and usage information, including your Internet Protocol address, browser type, device type, operating system, approximate location derived from an IP address, referring and exit pages, pages viewed, links selected, search terms entered on the Site, date and time of access, and similar diagnostic and interaction information.
We may collect this information through server logs, cookies, pixels, tags, local storage, and similar technologies. This information helps us operate, secure, troubleshoot, measure, and improve the Site.
3. GOOGLE ANALYTICS, COOKIES, AND SITE TECHNOLOGY
The Site uses a basic Google Analytics configuration to understand aggregate traffic and how visitors interact with Site content. Google Analytics may use first-party cookies and similar identifiers to collect information such as page views, session activity, approximate country or city derived from an IP address, device and browser information, referring sources, and outbound link interactions. Google processes this information under its own privacy terms.
MBVCA has not enabled Google Analytics Advertising Features and does not use Google Analytics for remarketing or personalized advertising. The Site does not currently use a Meta Pixel. Advertising campaigns managed independently by MBVCA’s agencies or other partners may link to the Site, but those campaigns are not directly integrated with the Site’s Google Analytics configuration for advertising reporting or tracking. Google Analytics may still record ordinary referral information or campaign parameters included in an incoming link. Activity on an advertising or social media platform before you reach the Site is governed by that platform’s and the applicable advertiser’s own privacy practices.
You can control or delete cookies through your browser settings. Disabling cookies may affect some Site functionality. Google also offers a Google Analytics opt-out browser add-on at https://tools.google.com/dlpage/gaoptout.
The Site is hosted and delivered using Webflow and may use infrastructure and security services, including Cloudflare. These providers may process technical information, form data, and logs as necessary to host, deliver, protect, and maintain the Site. Essential cookies or similar technologies may be used for security, network management, and basic functionality.
When you follow a link to Constant Contact, an app store, a social media platform, the browser-based tour platform, or another third-party service, that service may use its own cookies or similar technologies under its own privacy policy.
4. HOW WE USE INFORMATION
We may use information collected through the Site to:
• operate, maintain, secure, and improve the Site;
• understand Site usage and measure the effectiveness of MBVCA content and outreach;
• administer the newsletter and send the communications described above;
• receive, evaluate, edit, publish, and promote event submissions;
• confirm whether an event submission was accepted and ask follow-up questions;
• respond to inquiries and provide support;
• detect, investigate, and prevent fraud, misuse, security incidents, or technical problems;
• enforce these Terms and protect the rights, safety, and property of MBVCA, Site users, and others;
• comply with public-records, records-retention, legal, regulatory, and governmental obligations; and
• fulfill another purpose disclosed when information is collected or with your consent.
5. HOW WE DISCLOSE INFORMATION
We may disclose information:
• to service providers and contractors that host, secure, analyze, maintain, or support the Site and MBVCA communications, including Webflow, Cloudflare, Google Analytics, and Constant Contact;
• by publishing the event information, images, and other content that you submit for public posting;
• to government entities, regulators, courts, law enforcement, or other parties when required or permitted by law;
• in response to a valid public-records request, subpoena, court order, or legal process;
• when reasonably necessary to investigate misuse, protect security, enforce these Terms, or protect rights, safety, or property; or
• with your direction or consent.
Service providers may process information only as permitted by their agreements with MBVCA and their own applicable legal obligations. Their independent websites and services are also governed by their privacy notices.
MBVCA does not sell or rent the newsletter subscriber list and does not authorize unrelated third parties to use that list for their own marketing.
6. FLORIDA PUBLIC RECORDS
MBVCA is a public authority. Information made or received in connection with official MBVCA business may be a public record subject to Chapter 119, Florida Statutes, and other applicable public-records and retention requirements. Information may therefore be retained and disclosed in response to a public-records request unless an exemption applies.
Under Florida law, email addresses and electronic communications with a public entity may be public records. If you do not want your email address released in response to a public-records request, consider contacting MBVCA by telephone or postal mail instead of email or an online form. Do not submit confidential or sensitive information unless it is necessary and you understand the potential public-records implications.
7. DATA RETENTION
We retain information for as long as reasonably necessary for the purposes described in this Policy, including to operate the Site, administer subscriptions, review and document event submissions, resolve disputes, maintain security, and comply with legal and public-records retention obligations.
Newsletter information is generally retained while you remain subscribed and as necessary to maintain suppression records after you unsubscribe. Event submissions and related correspondence may be retained under applicable government records-retention schedules. Analytics and technical data are retained according to MBVCA’s settings and the practices of the applicable service provider.
8. YOUR CHOICES
You may:
• unsubscribe from newsletter emails using the link in any newsletter;
• control or delete cookies through your browser settings;
• use Google’s Analytics opt-out browser add-on;
• choose not to submit an event or other optional information; and
• contact MBVCA to ask about, correct, or update information you provided.
Requests concerning personal information are subject to identity verification, applicable law, public-records requirements, retention obligations, and technical limitations. We may retain information when required by law or when a legal exception applies.
9. DATA SECURITY
MBVCA and its service providers use administrative, technical, and physical measures designed to protect information. However, no website, transmission, or storage system can be guaranteed to be completely secure. You provide information online at your own risk and should not submit information that is unnecessary for the relevant purpose.
10. CHILDREN’S PRIVACY
The Site is intended for a general audience and is not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information through the Site, please contact MBVCA so that the matter can be reviewed and appropriate action taken, subject to applicable public-records and retention laws.
11. INTERNATIONAL VISITORS
The Site is operated in the United States. Information may be processed and stored in the United States or in other countries where MBVCA’s service providers operate. Privacy laws in those locations may differ from the laws where you live.
Depending on where you reside, you may have legal rights concerning personal information. You may contact MBVCA to submit a privacy-related request. MBVCA will evaluate the request under applicable law and any public-records, retention, or other legal obligations.
12. CHANGES TO THIS POLICY
We may update this Privacy Policy to reflect changes in the Site, our practices, technology, or legal requirements. The revised Policy will be posted on the Site with an updated “Last Updated” date. Material changes will apply prospectively unless otherwise required by law.

PART III — ACCESSIBILITY
1. OUR COMMITMENT
The Miami Beach Visitor and Convention Authority (“MBVCA”) is committed to providing access to ExperienceMiamiBeach.com (the “Site”) for people with disabilities and to supporting an inclusive experience for all visitors. Accessibility is an ongoing responsibility, and MBVCA continues to evaluate and improve the Site as content, features, technologies, and accessibility practices evolve.
This Accessibility Statement applies to ExperienceMiamiBeach.com. The EXP Miami Beach Tours mobile app, app-store experiences, separately hosted tour platforms, and third-party websites may provide their own accessibility information and support channels.
2. ACCESSIBILITY STANDARD AND ONGOING IMPROVEMENTS
MBVCA’s goal is to make the Site’s content and functionality consistent with the Web Content Accessibility Guidelines (“WCAG”) 2.1, Level AA. WCAG provides recommendations for making digital content more accessible to people with a wide range of disabilities, including visual, auditory, physical, speech, cognitive, language, learning, and neurological disabilities.
MBVCA has undertaken accessibility improvements and intends to continue reviewing the Site, correcting identified barriers, and considering accessibility when adding or updating content and functionality. Because accessibility work is ongoing, some portions of the Site may not yet fully satisfy every WCAG 2.1 Level AA success criterion, and accessibility may vary depending on the browser, device, assistive technology, and settings used.
Accessibility interfaces or user tools that may be offered on the Site are intended to supplement—not replace—MBVCA’s ongoing efforts to improve the accessibility of the Site’s underlying content, structure, and functionality.
3. ACCESSIBLE INFORMATION AND ALTERNATIVE FORMATS
If you have difficulty accessing any Site content or function, MBVCA will make reasonable efforts to provide the information through an accessible alternative or to assist you in completing the intended task. Depending on the request, an alternative may include assistance by telephone, a text-based version, an accessible electronic document, or another effective format.
When reporting an accessibility issue or requesting an alternative format, it is helpful to identify:
• the page address or URL;
• the content or function you were trying to access;
• a brief description of the barrier encountered;
• the preferred format or accommodation, if known; and
• how MBVCA may contact you regarding the request.
You are not required to disclose more information about a disability than is reasonably necessary to understand and respond to the accessibility need.
4. THIRD-PARTY DIGITAL CONTENT AND SERVICES
The Site includes links to or information from third parties, including event organizers, ticketing services, hotels, restaurants, attractions, deal providers, social media platforms, app stores, and tour technology providers. Some third-party content may also be embedded in or displayed through the Site.
MBVCA does not control the design, code, accessibility features, or accommodation practices of independently operated third-party websites, applications, platforms, or transaction systems. Their accessibility may vary and is governed by the applicable third party’s policies and practices. If you encounter a barrier after leaving the Site, you may wish to contact the third party directly.
If third-party content presented through the Site prevents you from accessing information available from MBVCA, please contact MBVCA. We will make reasonable efforts to help identify an accessible alternative for Site-controlled information. Nothing in this section limits any accessibility obligation that may apply under applicable law.
5. PHYSICAL ACCESSIBILITY OF LISTED LOCATIONS AND EXPERIENCES
The Site provides informational listings and recommendations for independently operated businesses, hotels, restaurants, venues, attractions, events, tours, public spaces, and other visitor experiences. Inclusion on the Site does not represent or guarantee that a location, route, event, service, or experience meets a particular physical-accessibility standard or will be suitable for every visitor.
Entrances, pathways, restrooms, seating, parking, transportation, communication aids, service-animal practices, sensory conditions, and available accommodations may vary by location and may change. Temporary conditions such as construction, weather, special events, closures, sand, tides, traffic, or maintenance may also affect access. Self-guided Tour routes may include public sidewalks, street crossings, outdoor areas, historic sites, or other surfaces and conditions outside MBVCA’s direct control.
Visitors with specific accessibility needs should contact the applicable business, venue, event organizer, attraction, transportation provider, or property operator before visiting to confirm current conditions and request accommodations. MBVCA will make reasonable efforts to assist with Site information but generally cannot confirm conditions or arrange accommodations for independently operated locations or events.
